Supreme Court Rules on Republican River

Kansas will be allowed to reopen a lawsuit against Nebraska over use of the water flowing in the Republican River. That was a decision handed down today by the U.S. Supreme Court.

The Court will allow Kansas to file a petition over its allegations that Nebraska used more than its allocated share of water from the river in 2005 and 2006. Kansas officials contend the overuse violated the settlement from a 1998 lawsuit between the
2-states. The High Court also appointed a special master to hear the new petition.

Use of the Republican River’s water, which runs locally through Jewell, Republic and Cloud Counties, is governed by a 1943 compact between Colorado, Kansas and Nebraska.
